The Retiring CJI To Set More Landmarks

The Tenure of current CJI Dipak Misra will come to halt on 2nd October. But before his retirement, he set to deliver more pathbreaking judgments after the Aadhar, Adultery, and Section 377. All these judgments coming in the month of September it can be called a landmark month in the history of Indian Law.

First, the Supreme Court scrapped the Section 377

A five-judge constitutional bench of Chief Justice Dipak Misra and Justices R.F. Nariman, A.M. Khanwilkar, D.Y. Chandrachud, and Indu Malhotra declared the section unconstitutional.

Secondly, the Aadhaar judgment.

A five-judge constitutional bench of CJI Dipak Misra, Justice AS Sikri, Justice DAY Chandrachud, Justice AM Khanwilkar and Justice Ashok Bhushan heard the case and declared the Aadhar to be constitutional but with certain restrictions.

Thirdly, Adultery section 497 of IPC has been called archaic and anti-women has been scrapped.

After these three landmark judgments, some more benchmarks will be set until the retirement of the CJI.

1. Babri Masjid-Ram Janmabhoomi Case

This historical case will be the one of the key judgment of the CJI. This case also depends upon the pronouncement that mosques were not essential to offer Namaz.

2. Sabarimala Issue

The issue of barring women to enter the temple, raised by an NGO and women activist is also a major judgment to be delivered in the coming few days.
