The Bombay High Court has allowed for an abortion to a 33 year old lady who is in the 30th week of pregnancy due to special reasons.
Though the Medical Termination of Pregnancy Act, 1971 only permits abortion till the 20th week of pregnancy under the Sub Section 2 of Section 3:
(2) Subject to the provisions of sub-section (4), a pregnancy may be terminated by a registered medical practitioner,- (a) where the length of the pregnancy does not exceed twelve weeks if such medical practitioner is, or (b) where the length of the pregnancy exceeds twelve weeks but does not exceed twenty weeks, if not less than two registered medical practitioners are.
The abortion has been approved due to the special condition of the foetus. The couple who already have a child with down syndrome had been advised by their doctor to undergo scan for any abnormalities. It was found that the foetus has schizencephaly. This condition causes delays in development of the child.
The couple had pleaded that of the birth of the child would be traumatic and would impose financial burden on them.
